2009 and Private Loans – Regulation Z and School-as-Lender (Presented 01/21/2010)
Part two of NCHELP’s webinar series on the final regulations issued in late October focused on school loan issues (Team II) that were included in the negotiated rulemaking sessions that took place earlier in 2009 presented by members of the NCHELP Regulations and Private Loan Committees. The new regulations implement changes brought about by the Higher Education Opportunity Act (HEOA). These regulations impact both FFELP and private loans.

Lender & Guarantor Issues - Team I Final Rules

Members of the NCHELP Regulations Committee covered the many new lender disclosure requirements, total and permanent disability changes, and rehabilitation reporting requirements. The final regulations (published 10/29/2009 and generally effective 07/01/2010) are from the negotiated rulemaking activities that concluded earlier this year to implement the provision from the Higher Education Opportunity Act (HEOA).

This webinar provided a summary of the many changes made to the Truth in Lending Act (TILA) brought about by the Higher Education Opportunity Act and the Federal Reserve Board's recently published amendments to Reg Z. Liquidity challenges as to how they impact loan availability and price, and private loan access for the 2009-10 academic year were discussed.
